4 COSTA RICA REAL ESTATE MAGAZINE The Project to attract foreign investors and pensioners - File 22-156 is an ini- tiative proposed by the Government of Costa Rica which is currently favorably working its way through the General Assembly and is aimed at contributing to the post pandemic reactivation of the Costa Rican economy and would have an effective term of 5 years from the moment the Law is published and has the option to extend up to a decade. It reduces from US$200,000 the amount
required to qualify for Residency under the Inversionista Resident program, down to US$150,000. Currently the law says the following for the Investors and their Dependents category of resi- dency applicants: Article 87.- For the application for tem- porary residence as an investor, the interested foreign person must demon- strate their investment with a capital of not less than US$ 200,000 (two hun- dred thousand dollars) according to the
official sale exchange rate determined by the BCCR, and whether in real es- tate, registrable assets, shares, securi- ties and productive projects or projects of national interest such as sustainable tourism infrastructure. In those cases where the investment is regulated by special laws, it will be analyzed indi- vidually. The proposed bill establishes that this will apply to all those persons who are authorized to enter our country under

The persons who Will Benefit under this proposed law would receive the follow- ing: • Duty free of all import taxes for one time only, for the importation of house- hold items. • Importation of a motor vehicle for per- sonal or family use, free of all import, tariff, sales and economic stabilization taxes, which may be sold or transferred to third parties, exempt from said taxes after three years have elapsed from the date of entry of the vehicle into the country. BUYING PROPERTY IN COSTA RICA 101-A PRIMER
You have visited Costa Rica, possibly several trips and you love it and you are ready to buy your own place in Paradise, great, you are making a wonderful decision!
Registry. Nearly all purchases require a due diligence period of 30 to 60 days so an Option to Buy-Sell is signed (Opción de Compra-Venta) where the key items are specified such as the property reg- istry information, the price, the option term, broker commissions and the key due diligence points that must be met in order for the down payment (given with signing of option) to be released to the seller by the Escrow company. Do not give the option money (which is usu- ally 10% unless agreed otherwise mu- tually), to the seller or his lawyer. Your lawyer should have a reputable escrow company he or she works with that will act as the independent third party in the transaction and that will abide by the op- tion to buy contract stipulations. For your protection always use your own trusted lawyer to look out for your interests and do not agree to use the seller´s lawyer as that opens you up to big potential trouble. All titled land in Costa Rica, whether it is registered following the newer ¨Folio Real¨ system or the older book/page/en- try system, can be accurately and safely title-searched in order to determine all relevant aspects on the specific proper- ty, such as ownership, mortgages, liens, annotations or other issues, that may af- fect ownership rights or the possibility of transferring said property to a third party. Title searches on ¨Folio Real¨ proper- ties may be initiated in the computer system, which is accessible online but will then possibly require a follow-up in the book/page/entry system, particularly when the computer search shows liens, encumbrances or other property charac- teristics that were ¨inherited¨ from older transactions on that land before it was transferred to the ¨Folio Real¨ system. Additionally, although the computer sys-
12 COSTA RICA REAL ESTATE MAGAZINE Few places have all the pluses that Costa Rica can offer for retirement, re- location and investment, so long as you do your homework properly! Do it right and you will be very happy but if you don´t do your due diligence and work with expert real estate and legal help to guide you, then you are basically rolling the dice and hoping to win. A big plus is that the foreign owner of property in Costa Rica has the same constitutional rights as Costa Rican citizens. One key piece of advice not usually given is that you should choose a good lawyer who will be the key person in getting things done correctly and safely in Costa Rica. Even before picking a Real Estate pro- fessional, find a good lawyer, preferably one who works daily with the area you are interested in buying your property in, although some San José lawyers are also excellent real estate specialists. A good lawyer will advice you on any pit- falls you might not have seen or even know about, and also knows who the reputable real estate firms or individuals in the chosen area are and can also help you to begin your residency application. In Costa Rica, mostly all land is titled, and those titles are registered and kept at the offices of the Public Registry in San José (the Capital city) in the Property Section (Registro de la Propiedad). Most titles are currently organized by means of a computerized system called the ¨Folio Real¨. A property ownership transfer re- quires that both the buyer and the seller sign a deed before a Costa Rican Notary Public (whose concept is different from the ones in many other countries such as Canada and the United States and is re- quired to formalize all transactions deal- ing with real estate transfers) and that the deed is then recorded at the Public

Although, as indicated, the ¨Folio Real¨ is accessible online, generally private parties do not have the legal training to be able to accurately interpret the in- formation acquired, as well as to know how best to follow-up any required fur- ther steps. This is why it is highly rec- ommended that a knowledgeable legal professional be used to perform and re- port on the title search. In addition to the title search, if the property is owned by a corporation, it is essential to undertake a corporate search at the Commercial Section of the Public Registry. Only by doing so, can you verify that this corpo- rate entity transferring the property is in good standing and also that the pro- posed signatory of the transfer deed ac- tually does have the legal power to do this transfer. Another important item to keep in mind when buying a property is the USO DE SUELO (what you are allowed to build or do on that property). For example, if you are buying a lot or built property for com- mercial purposes but the land is desig- nated for residential use only then you need to know this. Or you want to buy a lot and put several units on it but are only allowed a single residence or you want to have a Bed & Breakfast, but the municipality does not allow it, etc., etc. All of these pitfalls can easily be avoided with the use of a good lawyer and proper due diligence and the additional help of a good real estate professional.

COSTA RICA RESIDENCY REQUIREMENTS There are several
ways a foreign citizen can obtain residency in Costa Rica.

Obtaining residency is the way to go if you are serious about staying in Costa Rica, although some ex-pats who live in Costa Rica have become ¨perpetual tourists¨ and do a visa run to the border, mainly to Nicaragua every 90 days, this is a risky proposition because visas are renewed for ¨up to¨ 90 days but this is done at the discretion of the immigra- tion person at the border who can give you less time on that visa renewal or even deny it and then you are in a bad position. There is of course a bureau- cratic procedure to obtain your residen- cy and of course there are the related expenses. However; the advantages far outweigh the disadvantages. For example, only with a legal residency can a foreigner get a driver´s license, or be allowed to work legally, or get a post pay cell phone, or not need to carry around a passport, or get local prices at many places versus tourist prices, etc., etc., so it all begins to add up. Let´s see some of the various ways you can ob- tain residency: TEMPORARY RESIDENCY: PENSIONADO: Requires a monthly income of US$1000 per month. This
would be from a permanent fixed in- come like a pension like private sector, government or social security benefits. RENTISTA: Requires a monthly in- come of US$2500 per month and in- cludes spouse and children under 25 years of age. This category requires a permanent and stable source of in- come equal to or above US$2500 for two years which equals US$60,000 and is renewable. An international and recognized bank or financial institution must issue you a letter that states this or you can deposit the US$60,000 in a local bank and can take out $2500 per month. SPOUSE: Granted to the Spouse of a Costa Rican citizen under article 73 of the Immigration Law. WORK RELATED: Technical workers, Managers, Executives, Specialized workers, etc. of a company established in Costa Rica. INVESTORS: Foreigners who pur- chase Property for $200,000 or more can apply for the status of Investor by
presenting the proper documentation to Immigration. SPECIALIZED: Professional, Scientif- ic, and other such specialized individu- als deemed of value to the country. RELIGIOUS: Persons who are part of duly accredited religious orders and are so recognized by the Ministry of Foreign Relations and Culture. PRESS & SPORTS: International Press Correspondents & Recognized Sportsmen PERMANENT RESIDENCY: Permanent residency is a migratory condition that allows the person who obtains it, to remain indefinitely in the country and with the freedom to work. Persons eligible to apply for this type of residency are those whose parents or children are Costa Rican citizens. What is a Digital Nomad? Well for starters, it is a totally new category of Traveler/Resident. SHOULD YOU BUY A PROPERTY RIGHT AWAY OR RENT FOR A WHILE FIRST?

When you vacationed in the past you usually chose a destina- tion by the beach and you loved it each time, so now that you are ready to retire and live in Costa Rica, you believe it is the perfect time to buy a home at the beach which is much more affordable to do so here in Costa Rica. So, you are ready to jump right in and purchase that dream home or would you be wiser to wait? It depends on various factors so please take a sheet of paper and look at your overall situation, vacationing at the beach and living full time at the beach are not the same thing and for some the transition from one to the other may be perfectly smooth but for others it may be quite a rude awakening as it does not always result in the Endless Sum- mer fantasy you dreamt about for years. If you have previously lived full time at the beach then you know that you must take the good with the bad and weigh- ing both the Pros and Cons, you can then decide if full time beach living is for you. However, if you have never lived in a beachfront situation then possibly the wisest course to take is to rent for
a year and see what the full-time beach life with all its Pros and Cons is really like. Also, each beach community has a different flavor and living there will let you experience it and decide if it is what you are looking for because while living full-time at the beach may be perfect for you it may not be perfect for you in that specific beach location. Also, you may decide that beachfront is not right for you, but something set back a little with possibly more altitude to catch those lovely winds coming from the ocean is exactly the perfect compromise. You can catch the beautiful sunsets as you gaze from your beautiful home toward the sea but save yourself from several maintenance issues (the constant at- tack of salt-water spray can be unfor- givingly harsh on many of your home surfaces and vehicles) and have gen- erally cooler temperatures due to a higher altitude and prevailing winds so that you end up needing nothing more than a good ceiling fan to be comfort- able temperature wise. Now let us say that you have decided that while you love the beach, you would prefer to live inland, then you must decide what appeals more to you. Do you want to live away from the cities

and big towns in a small community or just be away from it all and sharing only with nature? Or are you someone that enjoys the hustle and bustle of living near the city with all the entertainment and art and culture it has to offer? Are you still young enough that a constant nightlife scene is very appealing? It is these and many more factors that you must consider including your monthly budget. Living in or near the city center is usually significantly more expensive than if you are living in a small town 30 minutes to an hour away. Living in a gated community is significantly more secure and specially if you spend weeks or months away from your resi- dence but again it is generally more expensive to do so, however, you not only get more security but also the use of common areas like pools, gyms and paths to walk, run or pedal. Also, if you are someone who looks forward to hav- ing a large garden with your own fruits and vegetables then you must consider that you will need a minimum land area in order to do so and the lots or lots with homes in gated communities are usu- ally not large enough for more than an herb garden with one or two small trees. Over the last 26 years I have been for- tunate to live in just about every resi- dential environment and area of Costa
Rica. I have both rented and owned and I have rented homes from $300 a month to as high as $2500 per month. I have done city living, rural living and beachfront living and have also built and developed homes and residential communities both inland and beach- front. I have learned from each experi- ence and my tastes have also changed over the years from being a single guy in his late 30´s wanting to live luxuri- ously and to have a great time to a per- son in his 60´s wanting to be in a qui- eter and more rural environment (but still within 60 minutes or less from all amenities and services offered by the big city) and wanting to build a home with lots of space to grow my own food and be off-grid capable should the need arise. I still enjoy the beach a lot, but I only need to drive an hour on well paved roads to get my quota of beach life when I feel the need and it is not much further to go and retreat deep into the mountains and tropical or cloud for- ests. That is the beauty of Costa Rica, there is so much to see and experience and yet the distances are such that you can experience an early breakfast on the Caribbean side and watch the sun come up and enjoy an early dinner on the Pacific Coast while you enjoy an- other spectacular Costa Rican sunset!
So, going back to the initial ques- tion of renting or buying, just ex- amine your experience, needs, wants, budget and your ultimate goals and make sure you are ready to take a step that will in- volve a significant outlay of your hard-earned cash. Unfortunately, none of my emails were answered. Shortly after returning home to Canada, we suffered one of the larg- est total loss house fires in the region that we lived in. This experience was both traumatic and life changing for our family. My real estate and property man- During this trip we discovered the Southern Pacific region of Costa Rica, and without a lot of planning or even a lot of discussion, we ended up buying a resort in Uvita. We returned a short time later with our children, and we pur- chased our home in Cinco Ven- tanas. By September 2012, we were living in Costa Rica full time, and starting our new lives. Do you recommend the move to Costa Rica as being better for a Retiree or is it equally good for a younger family who is able to work remotely or does not need to work? Do you see this as a good desti- nation for the Digital Nomad? Although a large number of our clients purchase a home in Costa Rica with the intention of using it as a vacation home and not moving here full time until they retire, a greater number of people have decided that moving to Costa Rica full time is a viable option for them. Several companies in the United States, Canada and Europe have allowed their employ- ees to work remotely during Covid which made the idea of living and working re- motely a reality. I am excited to see that there is likely going to be a new immigra- tion status in Costa Rica that will make it attractive for digital nomads to live and work in Costa Rica.
M rr Fenton, please tell us how you decided to come to Costa Rica and what made you decide to stay and to become a leading Real Es- tate Broker for High End properties at the South Pacific Beaches? We first visited Costa Rica in early 2012. On one of our last days of vacation, we rented a car and decided to visit the hot springs and Arenal volcano. During our drive, we encountered a sloth crossing the road, and while at the hot springs a toucan landed just a few feet away from where we were sitting. These two wild- life encounters had us hooked, and we started wondering what life would be like in Costa Rica (once we retired). I have worked in real estate since 1990, and so I instinctively sent emails to a few brand name real estate agencies be- cause I wanted to satisfy my curiosity.
