Buying Property in Costa Rica 101-A Primer You have visited Costa Rica, possibly several trips and you love it and you are ready to buy your own place in Paradise, great, you are making a wonderful decision!
10 COSTA RICA REAL ESTATE MAGAZINE as you do your homework properly! Do it right and you will be very happy but if you don´t do your due diligence and work with expert real estate and legal help to guide you, then you are basically rolling the dice and hoping to win. A big plus is that the foreign owner of property in Costa Rica has the same constitutional rights as Costa Rican citizens. One key piece of advice not usually given is that you should choose a good lawyer who will be the key person in getting things done correctly and safely in Costa Rica. Even before picking a Real Estate pro- fessional, find a good lawyer, preferably one who works daily with the area you are interested in buying your property in, although some San José lawyers are also excellent real estate specialists. A good lawyer will advice you on any pit- falls you might not have seen or even know about, and also knows who the reputable real estate firms or individuals in the chosen area are and can also help you to begin your residency application. In Costa Rica, mostly all land is titled, and those titles are registered and kept at the offices of the Public Registry in San José (the Capital city) in the Property Section (Registro de la Propiedad). Most titles are currently organized by means of a computerized system called the ¨Folio Real¨. A property ownership transfer re- quires that both the buyer and the seller sign a deed before a Costa Rican Notary Public (whose concept is different from the ones in many other countries such as Canada and the United States and is re- quired to formalize all transactions deal- ing with real estate transfers) and that the deed is then recorded at the Public F ew places have all the pluses that Costa Rica can offer for retirement, relocation and investment, so long

Nearly all purchases require a due diligence period of 30 to 60 days so an Option to Buy-Sell is signed (Opción de Compra-Venta) where the key items are specified such as the property reg- istry information, the price, the option term, broker commissions and the key due diligence points that must be met in order for the down payment (given with signing of option) to be released to the seller by the Escrow company. Do not give the option money (which is usu- ally 10% unless agreed otherwise mu- tually), to the seller or his lawyer. Your lawyer should have a reputable escrow company he or she works with that will act as the independent third party in the transaction and that will abide by the op- tion to buy contract stipulations. For your protection always use your own trusted lawyer to look out for your interests and do not agree to use the seller´s lawyer as that opens you up to big potential trouble. All titled land in Costa Rica, whether it is registered following the newer ¨Folio Real¨ system or the older book/page/en- try system, can be accurately and safely title-searched in order to determine all relevant aspects on the specific proper- ty, such as ownership, mortgages, liens, annotations or other issues, that may af- fect ownership rights or the possibility of transferring said property to a third party. Title searches on ¨Folio Real¨ proper- ties may be initiated in the computer system, which is accessible online but will then possibly require a follow-up in the book/page/entry system, particularly when the computer search shows liens, encumbrances or other property charac- teristics that were ¨inherited¨ from older transactions on that land before it was transferred to the ¨Folio Real¨ system. Additionally, although the computer sys-
tem will indicate a list of liens and en- cumbrances, in most cases a thorough and complete title search will require the review of microfilmed or scanned documents indicating the details of such finds, which are not accessible online and can only be obtained at the offices of the Public Registry. Although, as indicated, the ¨Folio Real¨ is accessible online, generally private parties do not have the legal training to be able to accurately interpret the in- formation acquired, as well as to know how best to follow-up any required fur- ther steps. This is why it is highly rec- ommended that a knowledgeable legal professional be used to perform and re- port on the title search. In addition to the title search, if the property is owned by a corporation, it is essential to undertake a corporate search at the Commercial Section of the Public Registry. Only by doing so, can you verify that this corpo- rate entity transferring the property is in good standing and also that the pro- posed signatory of the transfer deed ac- tually does have the legal power to do this transfer. Another important item to keep in mind when buying a property is the USO DE SUELO (what you are allowed to build or do on that property). For example, if you are buying a lot or built property for com- mercial purposes but the land is desig- nated for residential use only then you need to know this. Or you want to buy a lot and put several units on it but are only allowed a single residence or you want to have a Bed & Breakfast, but the municipality does not allow it, etc., etc. All of these pitfalls can easily be avoided with the use of a good lawyer and proper due diligence and the additional help of a good real estate professional.

T he rural city of Grecia, with a population of around 18,000, is located just 25 minutes from Alajuela and from major shopping options including Walmart, Price Club and very large malls as well as the Juan Santamaria International Airport (SJO) could well be the best place to live in due to a year/round spring-like weather and the friendly local residents. Grecia is the cleanest city in Costa Rica and on August 1989 was declared the cleanest city in Latin America at a meeting of the International Union of Municipalities in Ecuador. If you are looking for a great place to live in other than the beaches, then Grecia is a must see on your list of places to check out. COSTA RICA RESIDENCY REQUIREMENTS

There are several ways a foreign citizen can obtain residency in Costa Rica.
O btaining residency is the way to go if you are serious about staying in Costa Rica, although some ex-pats who live in Costa Rica have become ¨perpetual tourists¨ and do a visa run to the border, mainly to Nicaragua every 90 days, this is a risky proposition because visas are renewed for ¨up to¨ 90 days but this is done at the discretion of the immigration person at the border who can give you less time on that visa renewal or even deny it and then you are in a bad position. There is of course a bureaucratic procedure to obtain your residency and of course there are the related expenses. How- ever; the advantages far outweigh the disadvantages. For example, only with a legal residency can a foreigner get a driver´s license, or be allowed to work legally, or get a post pay cell phone, or not need to carry around a passport, or get local prices at many places versus tourist prices, etc., etc., so it all begins to add up. Let´s see some of the various ways you can obtain residency: TEMPORARY RESIDENCY: PENSIONADO: Requires a monthly income of US$1000 per month. This
would be from a permanent fixed in- come like a pension like private sector, government or social security benefits. RENTISTA: Requires a monthly in- come of US$2500 per month and in- cludes spouse and children under 25 years of age. This category requires a permanent and stable source of in- come equal to or above US$2500 for two years which equals US$60,000 and is renewable. An international and recognized bank or financial institution must issue you a letter that states this or you can deposit the US$60,000 in a local bank and can take out $2500 per month. EFFECT ON PROPERTY IN CONDOMINIUM IN THE TERRESTRIAL MARITIME ZONE
where the type of development that is carried out by the concessionaire will af- fect the concession in time and space, limiting the existence of the Condo- minium by the terms of validity that the concession may have in the maritime zone land, which can vary from 5 years to 20 years and can be renewed as long as there is no breach by the Conces- sionaire, or need for public utility. The extinction, termination or non-renewal of the concession directly affects the ex- istence of the condominium, the same thing not happening in case the condo- minium property is extinguished since it does not necessarily imply the termina- tion of the concession. The affectation of concessions to the condominium property regime is also an atypical situation since a relation- ship between public rights must coex- ist because the land will always belong to the Costa Rican State and a private right such as the domain exercised by a natural or legal person over a property; therefore, the treatment of the subject must be addressed differently to the af- fectation of a property in condominium regime, the greatest of which is that prior to the affectation of the concession to condominium property, there must be an authorization from the respec- tive municipality, as well as a guarantee from the Costa Rican Tourism Institute (ICT), and the Costa Rican Institute of Housing and Urban Planning (INVU).
That is why we can always say there exists a concession affecting property in condominium, but not a condominium affected by the Concession because what will prevail is the greater good, which in this case is the Concession. There is no right to property in condo- minium in the Maritime Terrestrial Zone, but what exists is an atypical figure of af- fectation or regulation of Condominium in Concession of the Restricted Zone. It is a figure that we can perfectly use to boost the real estate market in the coastal areas, however, it is essential to improve the acceptance by the Coastal Municipalities, the ICT and the INVU so that the processes are not bogged down, nor is there fear of this modality, but rather a greater dynamism so that the high costs, real estate taxes and fees paid can be distributed among the largest number of people, thereby generating more income to the Govern- ment coffers and a lower payment by property owners. In Costa Rica, the is- sue is not exhausted, on the contrary, it is necessary to establish more precise legislation in accordance with current reality. Definition of Property in Condomini- um: this refers to control over a certain property that is owned jointly with one or more persons. This is regulated by the 1999 Law Regulating Condominium Property (Ley Reguladora de la Propie- dad en Condominio).

S ubjecting a Land Maritime Zone (ZMT) Concession to affecta- tion of Property in Condominium is an issue that to date raises more questions than answers and must be addressed from various perspectives, through a modification to the Law and articles that could be contradictory, for example, Article 1 with respect to Article 3 of the Regulatory Law of Property In Condominium, since Article 1 limits the condominium regime at ZMT to its com- mercial and tourism exploitation, while Article 3 tells us about the wide range of zoning in the ZMT and that this can be affected to Property in Condominium, including for example, residential use. Let us recall that the Maritime Terrestrial Zone is divided into two portions or seg- ments, one that is the inalienable Public Zone of up to the 50 meter line, and the other the Restricted Zone of 150 me- ters from the 50 meter line to the 200 meter line, which is subject to granting by the Municipalities with prior approval of a Regulatory Plan, being this plan the one that determines the Zoning and

B efore the late 1990´s Playa Herradura was a quiet rural beach used mainly by local fishermen and local tourists and campers, however with the arrival of The Los Sueños Marina and Golf Course and the Marriott Hotel this sleepy beach was thrown into the spotlight. Now it is like two separate Herradura beaches that have sprung up as you come in on the one single road. Are you prepared when traveling FOR A medical emergency? When we travel, we usually consider details, such as where to stay, which airline, the time of the year to determine clothing needed, etc. However, what we are going to do in case a medical emergency arises is not on the list. Most people do not think about it or if they do, they think they can deal with it if it happens. Very few people travel prepared, but for these the surprise factor is controllable and resolved in a better way.
S o, what happens when we travel to another country and we are not prepared to face an emergency? A medical situation, which often does not threaten life, but can mean a high mon- etary cost, becomes a family emergency, where you not only have to see how to solve the medical part, but also the eco- nomic part that can become unmanage- able. This scenario is presented more times than I would like to tell. As a doctor in a touristy area of great growth, I have wit- nessed and interacted more than once with patients in this situation. They come to our country for a visit or to live looking for other life experiences; and surpris- 34 COSTA RICA REAL ESTATE MAGAZINE
ingly while enjoying their new destination they have an accident, present a medical emergency, and are not prepared. I clear- ly remember the case of a patient who while enjoying time on the beach, suffered a fall and ended up with a very compli- cated fracture. We received the call and reached the site, treated the patient on the scene properly, preparing him to be transferred by ambulance to our central clinic. Once in the clinic, after performing diagnostic and confirmatory exams, we determined the need for surgery to repair the fracture. A procedure that cannot be performed in our medical center, requir- ing a transfer to a high-resolution trauma center quickly because of the type of in-
jury and its possible complications. Be- ing in an area more than 4 hours by land from the specialized center, the medical recommendation was an air transfer to the corresponding medical center in or- der to timely manage the medical condi- tion and reduce the risk of complications. It is at this time that I am explaining to the patient and his relatives what is happen- ing and how it should be resolved, when they tell me that the patient does not have medical insurance of any kind, nor does he have the money available to deal with the medical expenses and due to time differences between our country and theirs, they cannot contact the bank to access more funds than those they carry.

T he Osa Peninsula´s Corcovado National Park for example, has been called by National Geographic ¨the most biologically intense place on Earth¨, with endless stretches of deserted beaches and immense uninhabited rain-soaked forests teeming with fauna and flora which make for magnificent viewings and encounters, making this truly an unforgettable place to visit. Sportfishing, diving, surfing, whale and dolphin watching tours, bird watching, sailing and other water sports, canopies, nature treks on foot and on horseback and much more are all here just waiting for your very own voyage of discovery. The South Pacific Coast is an area that ex- tends from Dominical in the North, past Uvita and Ojochal all the way to the Osa Peninsula and Golfito in the South. This long stretch of beautiful coastline is one of the most beautiful and unspoiled areas of Costa Rica as it concen- trates much of Costa Rica´s natural beauty.
